BRAZIL has signed most of the intellectual property relevant
international acts, being is a CUP primary signer, a WTO/WIPO/PCT
member, signed the TRIPS and adopted the NICE International
Classification 8th edition on January 01,2002.

The
term of 10 years of a trademark registration is counted from
the registration date while the 20 years of a patent counts
from the date of submission of the application form to the Brazil
Patent Office.

In
Brazil we have no multi-class system for trademarks

Renewal of a trademark registration is feasible within a year
before and within 6 months after (late renewal) the due date.

A registration shall become forfeit upon request of any person
with legitimate interest, if after five (5) years from its
grant, on the date of the request:
use of the mark in Brazil has not been initiated; or
use of the mark has been interrupted for more than five
(5) consecutive years or if within that same period the
mark has been used in a modified form that implies alteration
in its original distinctive character, as found on the certificate
of registration.
the
mark shall not become forfeit if the proprietor justifies
the lack of use for legitimate reasons.
